TERMS OF USE

These Terms of Service ("Terms") govern your access to and use of daytradeforecast.com (the "Website") and DTFC's subscription services (the "Service"), operated by G&N Terra Vision Ltd. ("DTFC," "we," "us," "our"). By creating an account, starting a trial, subscribing, logging in, or using the Service, you agree to these Terms. If you do not agree, do not use the Website or Service.

1) What DTFC provides

DTFC provides market-related information and next-day forecasts from a day trader's perspective for use by subscribers and eligible trial users. Content is provided for informational purposes only.

2) No financial advice / no recommendations

DTFC does not provide financial, investment, tax, accounting, or legal advice, and does not issue stock tips, stock ideas, or recommendations to buy or sell any security. You are solely responsible for your trading decisions and outcomes. Trading securities involves substantial risk, including the potential loss of capital.

3) Eligibility and account requirements

By using the Service, you confirm that:

⁕ You are 18 years or older.
⁕ You register using your legal name and email address (and other details requested during registration).
⁕ You are a human; automated/bot registrations are prohibited.
⁕ You are using the Service only for your personal, individual use and not for any business, institutional, or third-party purpose.
⁕ You will not use the Service for any illegal or unauthorized activity and will comply with laws applicable to you.

4) Registration, phone verification, and limits

- Account registration may require your legal name, address, email, and phone number. Only one registration per person is permitted.

- For free trial registration on daytradeforecast.com, we verify phone numbers using a one-time SMS code (OTP). Message/data rates may apply. No additional texts are sent unless you initiate another registration.

- Phone numbers are not shared with third parties, used to contact customers, or used for promotional purposes.

5) Access rules and device limits

⁕ Your login is for one person only and may not be shared.
⁕ You may access the Service from up to two (2) devices, from an unlimited number of IP addresses.
⁕ To enforce device limits, you consent to DTFC recording the MAC address/device identifier of your device(s).
⁕ Use through setups that enable multiple people to view or access one login (including certain remote desktop/concurrent viewing arrangements) is not permitted.
⁕ Your registered email address cannot be changed. If it is lost or compromised, contact DTFC support.

6) Intellectual property and permitted use

All forecasts, content, data, branding, and materials provided through the Service are owned by DTFC and protected by intellectual property laws. Your subscription grants you a limited, personal, non-transferable right to access the Service for your individual use.

You may not copy, reproduce, redistribute, republish, transmit, broadcast, resell, or share DTFC content or data-publicly or privately-whether in whole or in part, without DTFC's prior written permission.

7) Free Subscriptions and cancellation

- Subscription is currently offered free of charge.

- A credit card is not required to open an account.

- You can cancel your account at any time. Cancellation takes effect immediately.

If you cannot access your account, contact billing via the Website's contact page; however, online cancellation remains the primary method.

8) Service availability and third parties

The Service is provided "as is" and "as available." DTFC relies on third-party vendors for hosting, infrastructure, and certain data sources. While we aim for high availability, we do not guarantee uninterrupted or error-free operation, nor do we guarantee that any content will be accurate, complete, or timely.

9) User security responsibilities

You are responsible for safeguarding your password and account access. DTFC will not be liable for losses arising from unauthorized access resulting from your failure to secure your credentials.

10) Termination and enforcement

DTFC may suspend or terminate your account, in its sole discretion, at any time for violations of these Terms or misuse of the Service.

11) Limitation of liability

To the fullest extent permitted by law, DTFC (and its data providers, affiliates, agents, and licensors) will not be liable for any indirect, incidental, special, punitive, or consequential damages, including trading losses, lost profits, lost data, or business interruption, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

DTFC is not responsible for errors, omissions, delays, interruptions, third-party conduct, or decisions you make based on Service content. You accept that you may be exposed to inaccurate information and you use the Service at your own risk.

12) Indemnification

You agree to indemnify and hold harmless DTFC and its related parties from claims, losses, liabilities, and expenses arising from your breach of these Terms, misuse of the Service, or violation of any law or third-party rights.

13) No endorsement

DTFC and its Service are not sponsored, supported, or endorsed by any third-party data providers.

14) Force majeure

Neither you nor DTFC will be liable for delays or failures caused by events beyond reasonable control, including government actions, war, terrorism, civil unrest, natural disasters, epidemics, power/utility/communication outages, labor disputes, supply shortages, and equipment or software failures. Performance deadlines are extended for the duration of the event.

15) Governing law

These Terms are governed by the laws of Bulgaria, without regard to conflict-of-law principles.

16) Entire agreement

These Terms constitute the entire agreement between you and DTFC regarding the Service and supersede prior agreements or understandings. If DTFC does not enforce a provision, that does not waive its right to do so later.
